What is dowry?

Dowry is an ancient practice defined as giving of oversized gifts in the context of marriage.
It was conceived as ante-mortem or live inheritance for the bride in lieu of family inheritance meant for the sons only.

Over time the practice has become onerous and toxic for the bride and her parents.
Dowry now is not just given to the bride, there is expectation and a sense of entitlement by the groom and his family that they will receive for example large amount of gold, household furniture, cars, cash etc.

What is the issue?

Dowry is no longer spontaneous gift giving by family.
There are demands and even extortion by the groom and his family.
These demands are a significant contributor to family and domestic violence.

The pattern observed in Australia and many other countries globally is similar to the one reported in India, with documented extensive evidence of serious domestic violence in the context of “insufficient” dowry and gifts by the groom and his family.

Example of a letter from a victim in Australia 2014:

“I am 31 year-old modern girl raised and educated in India…I dated a guy online who lived in Australia”

“The matter of dowry was not discussed”

“(After marriage) whenever I used to ask him for money… he would taunt me, ask your father, did he give you money”

“Even when I started working, I was not allowed to buy things”

The mentality of these guys has not changed at all, even if they have become citizens of Australia. They think women should bring dowry to compensate them for taking on the burden of marrying a woman. Once married the woman is to be just confined to household chores and should not utter a word. Whether she is educated, working, earning income is immaterial.

Why this needs to be illegal

In Indian law, two kinds of remedies are provided to the victims:

  1. All dowry assets are retracted or retrieved from the groom/boy and his parents
  2. Criminal cases is registered against the whole family including the parents of dowry seekers and prosecuted.

Due to the non-existence of such a law, these two kinds of problems prevail consistently in Australia. Permanent residents or families that some live in India and some in Australia, hide behind the absence of laws and demand dowries where for the same actions would be prosecuted in India.

Royal Commission has recommended that The Victorian Government amend section 6 of the Family Violence Protection Act 2008 (Vic) to expand the statutory examples of family violence to include forced marriage and dowry-related abuse [within 12 months].

06/08/2018 – The Anti-Dowry abuse Bill passes the both houses of Parliament of Victoria unanimously as part of the Justice Legislation Amendment Bill. 7 MP s from all sides of the Parliament spoke in favour of the Amendment. The Hon Gabrielle Williams, Ms Danielle Green MP, Ms Heidi Victoria MP, Sen Georgie Crozier, Sen Inga Peulich and Greens leader Samantha Rtanam, Each MP cited the ACHRH Executive Director Dr Manjula O’Connor’s exemplary research, advocacy and leadership in bringing this complex issue to light and saving lives.   
 
On 29 March 2019 ACHRH Petition becomes law within the Act of Family Violence Protection of Victoria. Demands for dowry, gifts, cash will be deemed as an act of Family Violence.
